I. Definitions

Service
The website available at www.support.ipslink.pl.
Administrator
The administrator of the Service / the administrator of users' personal data is Dawid Pieron operating under the business name InterMedia - Dawid Pieron with its registered office in Niepołomice. Contact details: ul. Zawiła 17, 32-005 Niepołomice, e-mail [email protected].
User
Any person who has an account in the Service.
IP Address
A unique number usually assigned to each device connected to the Internet.
Server Logs
Automatic computer records of information sent to the server by the User's device during each connection. This may include in particular the IP address, which may allow an approximate identification of the location from which the connection to the website was made.

II. Users' Personal Data

  1. Personal data means information about an identified or identifiable natural person. Processing of personal data generally means any operation performed on personal data, regardless of whether it is carried out by automated means or not, such as collecting, storing, recording, organizing, modifying, reviewing, using, sharing, restricting, deleting, or destroying.
  2. The User provides personal data to the Administrator by using forms available on the Service, i.e. during registration of a Service user account and subscription to the newsletter. The scope of collected user data includes: username, password, and e-mail address. Personal data is provided voluntarily, however failure to provide such data makes it impossible to create an account in the Service, use the Service, or subscribe to the newsletter.
  3. The User may also voluntarily provide gender or location information - however these data are not required to use the Service.

III. Server Logs

Using the Service involves sending requests to the server on which the Service is stored. Such requests are recorded in server logs (including the User's IP address, server date and time). These data are not associated with specific individuals using the Service and are not used by the Administrator to identify the User.

IV. Purpose of Processing Users' Data

User data is processed solely for the purposes for which it was collected, namely:

  1. For purposes necessary for Users to use the Service. The legal basis for processing personal data for this purpose is the performance of the User’s rights resulting from joining the Service (legal basis: Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter “GDPR”)).
  2. For the purposes of the legitimate interests pursued by the Administrator (legal basis: Article 6(1)(f) GDPR), in particular for: archival purposes, creating backups necessary to ensure the security of data stored within the Service, and for purposes necessary to establish, pursue, or defend potential legal claims.
  3. Sending commercial information by the Administrator to the User at the e-mail address provided by the User - the basis for such processing is the User's consent (legal basis: Article 6(1)(a) GDPR).

VI. Data Retention Period

The Administrator will process Users' data for the following period:

  1. For the duration of the User's account in the Service. Data of a User whose account has been deleted may still be processed by the Administrator in backup copies until those backups are updated.
  2. In the case of processing data for the purpose of pursuing the legitimate interests of the Administrator (for archival purposes, backups and other purposes mentioned above), until those interests are fulfilled or until the User objects to such processing.
  3. If the User has given consent to receive commercial information electronically, the User’s data may be processed for this purpose until such consent is withdrawn.

VII. Sharing Users' Personal Data

  1. Access to Users' personal data is granted to the Administrator or persons authorized by the Administrator.
  2. Users' personal data in the scope including the username may also be visible to other Users of the Service.
  3. The Administrator may share Users' data with entities authorized under applicable law, including public authorities for the purposes of and in connection with proceedings conducted by those authorities (e.g. police, prosecutors, courts), or in order to defend against claims or pursue potential claims by the Administrator.
  4. The Administrator may transfer Users' data to entities processing data on behalf of the Administrator (e.g. hosting service providers such as webh.pl (ul. Piotrkowska 148/150, 90-063 Łódź)) only on the basis of an agreement with the Administrator - such entities process data as subcontractors and only in accordance with the Administrator’s instructions.

VIII. Users' Rights

The User has the following rights:

  1. The right to request access to their data, rectification, deletion, or restriction of processing.
  2. The right to object to processing where processing is carried out for the purposes of the legitimate interests pursued by the Administrator.
  3. The right to data portability.
  4. The right to withdraw consent for the processing of personal data for a specific purpose if the User previously gave such consent. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.
  5. The right to lodge a complaint with the President of the Personal Data Protection Office regarding the processing of personal data by the Administrator.

IX. Security of Users' Personal Data

The Administrator declares that it processes users' personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. In particular, the Administrator declares that all necessary technical and organizational measures have been implemented to ensure the proper protection of Users' personal data.

X. What Are “Cookies”?

“Cookies” are small pieces of information, in particular text files, stored on users’ end devices intended for using websites. These files allow recognition of the user’s device and proper display of the website adapted to their individual preferences. “Cookies” usually contain the name of the website they come from, the time they are stored on the end device, and a unique number.

Third Parties

Google Analytics
Google Analytics is a web analysis service provided by Google Inc. (“Google”). Google utilizes the Data collected to track and examine the use of this website, to prepare reports on its activities and share them with other Google services.
Spam Defense
The IPS Spam Defense Service passes the email address and IP address of the registering member to the service to determine the likelihood a registering account is a spam source.
hCaptcha
We use the hCaptcha anti-bot service (hereinafter "hCaptcha") on our website. This service is provided by Intuition Machines, Inc., a Delaware US Corporation ("IMI"). hCaptcha is used to check whether the data entered on our website (such as on a login page or contact form) has been entered by a human or by an automated program. To do this, hCaptcha analyzes the behavior of the website or mobile app visitor based on various characteristics. This analysis starts automatically as soon as the website or mobile app visitor enters a part of the website or app with hCaptcha enabled. For the analysis, hCaptcha evaluates various information (e.g. IP address, how long the visitor has been on the website or app, or mouse movements made by the user). The data collected during the analysis will be forwarded to IMI. hCaptcha analysis in the "invisible mode" may take place completely in the background. Website or app visitors are not advised that such an analysis is taking place if the user is not shown a challenge. Data processing is based on Art. 6(1)(f) of the GDPR (DSGVO): the website or mobile app operator has a legitimate interest in protecting its site from abusive automated crawling and spam. IMI acts as a "data processor" acting on behalf of its customers as defined under the GDPR, and a "service provider" for the purposes of the California Consumer Privacy Act (CCPA).
