Guidelines

I. Processing and Protection of Users' Personal Data

  1. The administrator of the personal data of Service Users is InterMedia - Dawid Pieron, ul. Zawiła 17, 32-005 Niepołomice, hereinafter referred to as the "Administrator". Contact details: [email protected], tel. (+48) 505-104-397.
  2. Users' personal data may be processed for the following purposes:
    1. For purposes necessary for Users to use the Service. The legal basis for processing personal data for this purpose is the performance of the User's rights resulting from joining the Service (legal basis: Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter “GDPR”)).
    2. For the purposes of the legitimate interests pursued by the Administrator (legal basis: Article 6(1)(f) GDPR), in particular for: archival purposes, creating backups necessary to ensure the security of data stored within the Service, and for purposes necessary to establish, pursue, or defend potential legal claims.
    3. Sending commercial information by the Administrator to the User at the email address provided by the User - the basis for such processing is the User's consent (legal basis: Article 6(1)(a) GDPR).
  3. The Administrator will process Users' data for the following period:
    1. For the duration of the User's account in the Service. Data of a User whose account has been deleted may still be processed by the Administrator in backup copies until those backups are updated.
    2. In the case of processing data for the purpose of pursuing the legitimate interests of the Administrator, until those interests are fulfilled or until the User objects to such processing.
    3. If the User has given consent to receive commercial information electronically, the User's data may be processed for this purpose until such consent is withdrawn.
  4. Users' data may be shared with the following recipients:
    1. Entities processing data on behalf of the Administrator (e.g. hosting service providers such as: webh.pl (ul. Piotrkowska 148/150, 90-063 Łódź)) only on the basis of an agreement with the Administrator - such entities process data as subcontractors and only in accordance with the Administrator’s instructions.
    2. Entities authorized to receive such data under applicable law, including public authorities for the purposes of and in connection with proceedings conducted by those authorities (e.g. police, prosecutors, courts), or in order to defend against claims or pursue potential claims by the Administrator.
  5. The Administrator informs that all Service Users are entitled to the following rights under the GDPR:
    1. The right to access their personal data, including the right to obtain a copy of such data.
    2. The right to request the rectification (correction) of personal data if the data is inaccurate or incomplete.
    3. The right to request the deletion of personal data (the so-called “right to be forgotten”) processed without legal basis or unlawfully in cases where:
      • the data is no longer necessary for the purposes for which it was collected,
      • the User has objected to the processing of their personal data,
      • the User has withdrawn consent for the processing of their personal data and there is no other legal basis for the processing,
      • the personal data is processed unlawfully,
      • the data must be deleted in order to comply with a legal obligation.
    4. The right to request the restriction of the processing of the User's personal data in cases where:
      • the User contests the accuracy of the data,
      • the processing is unlawful and the User opposes the deletion of the data and instead requests restriction of its use,
      • the Administrator no longer needs the data for its purposes but the person to whom the data relates requires it for the establishment, defense, or pursuit of legal claims,
      • the User has objected to the processing of their personal data - pending the verification whether the legitimate grounds of the Administrator override those of the User.
    5. The right to data portability where the processing is based on consent or a contract and the processing is carried out by automated means, meaning the User has the right to request that their personal data be transmitted to another administrator where technically feasible.
    6. The right to object to the processing of the User's personal data where the legal basis for such processing is the legitimate interest of the Administrator.
    7. The right to withdraw consent for the processing of personal data at any time without affecting the lawfulness of processing carried out based on consent before its withdrawal.
    8. The right to lodge a complaint with the supervisory authority responsible for personal data protection in Poland (currently the President of the Personal Data Protection Office) if the User believes that the processing of their personal data violates the GDPR.
  6. Providing data for the purpose of creating a User account and using that account is voluntary; however, failure to provide such data will result in the inability to create an account in the Service.
